Who Can Obtain A Permit
A building permit can be obtained by either a contractor or an owner/builder. These terms are defined below:
CONTRACTOR:
Means the person who is qualified for, and authorized to obtain building permits, and shall only be responsible for the project contracted for and means, except as exempted by State Statute or County Code, the person who, for compensation, undertakes to, submits a bid to, advertises to, or does himself or by others construct, repair, alter, remodel, add to, demolish, subtract from or improve any building or structure, including related improvements to real estate, for others or for resale to others; and whose job scope is substantially similar to the job scope described by State Statute or County Code governing contractor licensing. To obtain a Building Permit in the unincorporated areas of the county, the contractor shall be a holder of a Certificate of Competency issued by Miami-Dade County or the State of Florida. The contractor will be required to submit an authorization form signed by the owner for any work over $2,500.00.
OWNER/BUILDER:
Any owner of residential property who is building, altering, improving, or repairing outbuildings or one single family residence on such property for the occupancy or use of such owner, and not intended or offered for sale or rent. Owner/builders are required to sign an affidavit that they will:
- Do all physical work without use of hired labor or contractors; or
- Use licensed contractors whose license number and name appears on the permit application and will be posted on the on-site permit card; or
- Any person working on your building who is not licensed must work under your supervision and must be employed by you, which means that you must deduct F.I.C.A. and withholding tax and provide workers’ compensation for that employee, all as prescribed by law.
